Terms of use
Effective: September 17, 2026
1. Agreement to these Terms
These Terms of Use (“Terms”) govern your access to and use of the website located at milaude.com, our related pages, content, and services, and your purchase of products from Milaude LLC, a Wyoming limited liability company with its principal place of business in South Carolina (“Milaude,” “we,” “us,” or “our”). By accessing the site, creating an account, joining our mailing list, or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, which are incorporated by reference. If you do not agree, do not use the site or purchase our products.
We may update these Terms from time to time. The “Last updated” date shows when the current version took effect. Changes apply to orders placed and use occurring after the change is posted; they do not change the terms of an order already placed.
2. Who may use the site
You must be at least 18 years old, or the age of majority where you live if higher, to purchase from Milaude or create an account. By using the site you represent that you meet this requirement, that any information you give us is accurate, and that you are using the site for personal, non-commercial purposes unless we have agreed otherwise in writing. We may refuse service, close accounts, or cancel orders at our discretion, including where we reasonably suspect fraud, resale, or misuse.
3. Our products are cosmetics
Milaude products are cosmetic skincare products intended to cleanse, moisturize, and enhance the appearance of the skin. They are not drugs, are not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition, and have not been evaluated for any such purpose. Product descriptions refer to the appearance of the skin. Individual results vary. Nothing on the site is medical advice. You are responsible for reviewing ingredient lists and directions before use, for performing a patch test, and for consulting a qualified healthcare professional if you have a skin condition, allergy, or sensitivity, or if you are pregnant or nursing. Discontinue use if irritation occurs. Our full [Product Information & Disclaimers] apply.
4. Product information, pricing, and availability
We try to describe our products and display their colors, textures, and packaging accurately, but we do not warrant that descriptions, images, or other content are complete, current, or error-free, and your screen may display colors differently. Ingredient lists on the site are provided for information; the list on the product’s packaging is authoritative, and formulations may change.
All prices are in U.S. dollars and exclude shipping and taxes unless stated otherwise. Prices, promotions, and availability may change at any time without notice. We may limit quantities per order, per customer, or per household. If a product is listed at an incorrect price or with incorrect information, we may cancel or refuse any order placed for that product, including after your order is confirmed, and will refund any amount charged.
5. Orders and payment
Your order is an offer to buy. We accept your order when we ship it and send a shipping confirmation; an order-confirmation email acknowledges receipt only. We may decline or cancel any order in whole or part before shipment, for any reason permitted by law, with a full refund of amounts paid for the cancelled items.
Payment is processed at checkout through Shopify Payments and the payment methods it supports. By providing a payment method you represent that you are authorized to use it and authorize us and our payment processor to charge the total order amount, including shipping and applicable taxes. Sales tax is calculated and collected where we are required to do so. We do not store full payment-card numbers.
Promotion codes and discounts are subject to their stated terms, cannot be combined unless expressly permitted, have no cash value, and may be withdrawn at any time. We may cancel orders that use a code obtained or used in violation of its terms.
6. Shipping, risk of loss, and returns
Shipping methods, costs, processing times, and destinations are described in our [Shipping Policy]. Delivery estimates are estimates. Title to and risk of loss for products pass to you when we deliver the package to the carrier. Returns, exchanges, and refunds are governed by our [Returns & Refunds Policy]. Nothing in these Terms limits any right you have under applicable law with respect to defective products.
7. Accounts and communications
You may create an account to manage orders and preferences. You are responsible for keeping your credentials confidential and for all activity under your account, and you agree to notify us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms.
By providing your email address you agree to receive transactional emails about your orders and account. Marketing emails are sent only with your consent, and you may unsubscribe at any time using the link in any email. Text messages, if offered, are sent only after your separate express consent under the program terms presented when you opt in; message and data rates may apply, and you can reply STOP at any time. You consent to receive notices and disclosures from us electronically, and you agree that electronic communications satisfy any legal requirement that they be in writing.
8. Intellectual property
The site and everything on it — including the Milaude name and logo, product names, text, images, graphics, page designs, and the selection and arrangement of content — are owned by or licensed to Milaude and protected by U.S. and international copyright, trademark, and other laws. MILAUDE, the MM monogram, PURE RADIANCE, ETERNAL RENEWAL, and GLOW BODY BALM are trademarks of Milaude LLC. Third-party ingredient trademarks belong to their respective owners. You may view and print pages for your personal use; you may not copy, reproduce, republish, distribute, modify, create derivative works from, scrape, frame, or commercially exploit any part of the site or its content without our prior written permission.
9. Reviews and content you submit
If you submit a review, comment, photo, question, or other content (“User Content”), you grant Milaude a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, display, and distribute that content in any media, together with the name or handle you submit with it, for any purpose connected with our business, including marketing. You represent that you own or have the rights to your User Content, that it reflects your genuine experience or opinion, and that it does not infringe any third party’s rights or violate any law.
You may not submit content that is false, misleading, defamatory, obscene, harassing, discriminatory, or that contains personal information about another person, promotional material for another business, malware, or medical claims about Milaude products. If you received a free product, discount, or any other benefit in connection with your review, you must clearly disclose it. We may moderate, edit for length, or remove User Content that violates these rules, but we do not remove or hide reviews because of their rating, and we do not publish reviews we know to be fabricated.
10. Acceptable use
You agree not to: use the site for any unlawful purpose; place fraudulent orders or orders for resale; use bots, scrapers, or automated means to access the site or purchase products; interfere with the site’s security or operation; attempt to gain unauthorized access to any system or account; impersonate any person; upload malicious code; or use our name, marks, or content in a way that suggests affiliation or endorsement we have not given.
11. Third-party services and links
Our store runs on the Shopify platform, and we use third-party providers for payment processing, fulfillment, shipping, email, analytics, and other services. The site may link to third-party websites and social media platforms. We do not control and are not responsible for third-party sites, services, or content, and your use of them is governed by their terms and privacy policies.
12. Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR OUR RETURNS & REFUNDS POLICY, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, ITS CONTENT, AND OUR PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PRODUCT WILL PRODUCE ANY PARTICULAR RESULT FOR YOU. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU, AND NOTHING IN THIS SECTION LIMITS RIGHTS YOU HAVE AS A CONSUMER THAT CANNOT BE WAIVED.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MILAUDE AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM, AND OUR TOTAL LIABILITY FOR ANY OTHER CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR PERSONAL INJURY CAUSED BY A DEFECTIVE PRODUCT WHERE SUCH LIMITATION IS PROHIBITED.
14. Indemnification
You agree to indemnify and hold harmless Milaude and its members, managers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your violation of these Terms, your violation of any law or third-party right, or your misuse of the site or our products contrary to their directions.
15. Dispute resolution
15.1 Talk to us first
Most concerns can be resolved quickly. Before starting any formal proceeding, you agree to contact us at care@milaude.com describing the issue and the resolution you seek, and to give us 30 days to respond and try to resolve it.
15.2 Binding arbitration
If we cannot resolve a dispute informally, you and Milaude agree that any dispute, claim, or controversy arising out of or relating to these Terms, the site, or any product (a “Dispute”) will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies. The Federal Arbitration Act governs this section. The arbitrator has exclusive authority to resolve any Dispute, including the scope and enforceability of this section. The arbitration will be conducted in the county where you live or by video or telephone at your election; Milaude will pay all AAA filing, administrative, and arbitrator fees for claims under $10,000 unless the arbitrator finds the claim frivolous. Judgment on the award may be entered in any court of competent jurisdiction.
15.3 Class-action waiver
YOU AND MILAUDE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of more than one person or award relief affecting anyone other than the individual claimant. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court under Section 15.7.
15.4 Exceptions
This section does not apply to claims for injunctive relief to protect intellectual property, and either party may seek public injunctive relief in court where required by law.
15.5 Your right to opt out
You may opt out of Sections 15.2 and 15.3 by emailing care@milaude.com with the subject line “Arbitration Opt-Out,” your name, and your email address, within 30 days after you first accept these Terms or place your first order, whichever is earlier. Opting out does not affect any other part of these Terms.
15.6 Changes
If we change this Section 15 after you accept these Terms, you may reject the change by notifying us within 30 days, in which case the prior version applies to Disputes between us.
15.7 Governing law and venue
These Terms and any Dispute are governed by the laws of the State of South Carolina and applicable federal law, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs Section 15.2. Subject to Section 15.2, you and Milaude consent to the exclusive jurisdiction and venue of the state and federal courts located in York County, South Carolina, for any Dispute not subject to arbitration, and waive any objection to that venue. Nothing in this section deprives you of the protection of consumer laws of the state where you live that cannot be waived by contract.
16. Termination
We may suspend or terminate your access to the site or your account at any time for violation of these Terms or where we reasonably believe it necessary to protect Milaude, our customers, or third parties. Sections 3, 8, 9, and 12 through 19 survive termination.
17. General
These Terms, with the policies incorporated by reference, are the entire agreement between you and Milaude regarding the site and your purchases. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. Nothing in these Terms creates any partnership, agency, or employment relationship. Headings are for convenience only. We are not responsible for delays or failures caused by events beyond our reasonable control.
18. Accessibility
Milaude is committed to making its site usable by as many people as possible. If you encounter an accessibility barrier, contact us at care@milaude.com and we will work with you to provide the information or complete the transaction through another method.
